Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the Esme application (the “Service”) operated by Esme (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Esme is an end-to-end encrypted messaging application. We provide the infrastructure for you to send encrypted messages, but we cannot view the content of those messages.
You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 13 years of age.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”).
Use at Your Own Risk: You acknowledge that Esme cannot decrypt or moderate your private messages. You are solely responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness. Esme assumes no liability for content exchanged between users.
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”).
Refunds: All sales are final. We do not offer refunds for any purchases or subscriptions, except where required by law.
You agree not to use the Service:
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
